Terms of Service

1. Agreement

These Terms of Service ("Terms") are an agreement between you and WIDE WORLD LLC ("we", "us"), 75 E 3rd St, Ste S288, Sheridan, WY 82801, USA, and govern your use of the GoFax app, website, and fax service (the "Service"). By using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

2. Eligibility and accounts

• You must be at least 18 years old, or the age of majority where you live, to make purchases or use the Service.
• You may use the app without signing in. Your anonymous account is tied to your device; if you lose the device or delete the app before linking a sign-in method, you may lose access to your history and credits.
• You are responsible for activity on your account and for keeping your device secure.
• You must provide an accurate sender name: your own name, or the name of a business or organization you are authorized to send for. It is printed on every page you send, as required by law. We keep a history of sender name changes to investigate complaints.

3. The Service

GoFax lets you scan or import documents, preview how they will look as a fax, and send them to fax numbers in the United States and Canada. Getting a fax number and receiving faxes are planned for a future update and are not available yet; when they launch, these Terms will apply to them.

Sender identification header

US law (47 U.S.C. § 227(d) and 47 C.F.R. § 68.318(d)) requires every fax to clearly show the date and time it was sent, the identity of the sender, and the telephone number of the sending machine. GoFax adds this header to every page automatically, for example:

• FROM shows the sender name you enter, followed by "(via GoFax)". You are the sender of the fax, and you are responsible for it.
• FAX shows the number of the machine that actually sends the fax. Today this is a shared GoFax sending number used for many customers, not a number that belongs to you. Recipients who want to report a fax or stop faxes can use our report page.
• You can't remove or change the header, and you must not try to hide it (for example, by covering it with page content).

Delivery

Fax delivery depends on the telephone network and the recipient's equipment. We retry when a line is busy or doesn't answer, but we can't guarantee that every fax will be delivered or delivered by a particular time. Don't rely on GoFax for emergencies or for deadlines where a late or failed fax would cause serious harm without another way to send.

4. Accepted fax numbers

You can send faxes to:

• Geographic fax numbers in the United States and Canada; and
• Toll-free numbers with area codes 800, 833, 844, 855, 866, 877, and 888.

You can't send faxes to premium-rate numbers (such as 900 and 976), to 555 or N11 numbers, to countries other than the US and Canada that use the +1 country code (for example, Caribbean countries), or, at this time, to US territories (Puerto Rico, Guam, the US Virgin Islands, the Northern Mariana Islands, and American Samoa). We may change the list of supported destinations; the app checks every number before you pay.

5. Acceptable use and the junk fax prohibition

GoFax is for sending your own documents, or your organization's documents with its permission, to people and organizations that expect them. Advertising and telemarketing faxes are prohibited on GoFax, with no exceptions.

United States

The Telephone Consumer Protection Act (47 U.S.C. § 227), as amended by the Junk Fax Prevention Act of 2005, and FCC rules (47 C.F.R. § 64.1200) generally prohibit sending an unsolicited advertisement to a fax machine. Violations can lead to fines and statutory damages for each fax. Even where the law would allow an advertisement (for example, with an established business relationship or prior permission), you may not send advertisements through GoFax.

Canada

The CRTC's Unsolicited Telecommunications Rules, including the National Do Not Call List rules, restrict telemarketing faxes (faxes that sell or promote a product, service, or interest). You may not send telemarketing faxes to Canadian numbers through GoFax, whether or not the number is on the National Do Not Call List.

You agree not to

• Send any advertisement, promotional material, or telemarketing fax, even if you believe an exception applies.
• Send faxes in bulk or broadcast faxes, or send the same or similar document to many recipients.
• Send faxes to numbers obtained from lists, directories, or scraping, or to recipients who haven't asked to hear from you.
• Keep faxing a recipient who has asked you, or us, to stop.
• Impersonate anyone. Enter a sender name that isn't yours or that of an organization you are authorized to send for, falsely suggest you are acting for a government agency, court, insurer, healthcare provider, or other organization, or send on someone else's behalf without their permission.
• Send faxes to deceive or defraud, including fake invoices, phishing, or forged documents.
• Harass or threaten anyone.
• Send content that is illegal, infringes someone else's rights, or that you don't have the right to send.
• Use automated scripts, multiple accounts, or multiple devices to get around limits or to get additional free faxes.
• Interfere with, probe, or reverse engineer the Service, or resell it without our written permission.

Your responsibility

You are responsible for the content of every fax you send and for making sure the recipient wants it and that you are allowed to send it. If you break these rules, we may close your account immediately (see section 7), and you agree to cover the fines, damages, and costs that result (see section 14). We may share information about a violation with our fax carrier, recipients who complain, and authorities as permitted by law.

Our fax carrier holds us responsible for traffic on our network, and we take reports seriously. Anyone who receives an unwanted fax sent through GoFax can report it or ask us to stop faxes to their number on our report page.

6. Sending limits

To prevent abuse, every account is subject to sending limits, currently:

• 10 faxes per hour and 30 faxes per day;
• 5 faxes to the same fax number in any 24 hours;
• one free first fax (up to 3 pages) per device; and
• the page limits of your plan (currently up to 100 pages per week on Send Weekly), as described on the Pricing page.

We may change these limits at any time to protect the Service. The current limits are always published on the Pricing page.

7. Suspension and termination

We may automatically pause (freeze) an account while we review it, without prior notice, if we see signs of abuse. Examples include faxing a large number of different numbers in one day (currently 50 or more), repeated failed faxes that suggest junk faxing, complaints from recipients, a negative credit balance that recurs, or a store refund on credits that were already used. While an account is paused, you can't send faxes. We review paused accounts and either restore them or close them.

We may suspend or terminate your account, release your fax numbers, and refuse future service if you violate these Terms, if required by law or our fax carrier, or to protect recipients, other users, or the Service. Where the law allows, credits on an account terminated for violating these Terms are forfeited. You can stop using the Service at any time and delete your account in the app; see how to delete your account. Deleting your account does not cancel a subscription billed by Apple or Google.

8. Purchases, subscriptions, and credits

• Plans available. Single Fax and Send Weekly can be purchased today. Plans shown as "Coming soon" on the Pricing page can't be purchased yet, and their planned prices and features may change.
• Billing. All purchases are made through the Apple App Store or Google Play and are subject to their terms. Prices are shown in the app before you buy and listed on the Pricing page.
• Subscriptions (currently Send Weekly) renew automatically at the same price and length unless you cancel at least 24 hours before the end of the current period. You can cancel anytime in your App Store or Google Play account; your plan stays active until the end of the paid period. See how to cancel.
• Credits. A Single Fax purchase gives you one fax credit for up to 10 pages. Credits have no cash value, can't be transferred, and are used only within GoFax. Credits don't expire.
• Page limits. Send Weekly includes up to 100 pages per week, subject to the sending limits in section 6.
• Store refunds of used credits. If a purchase is refunded by Apple or Google after its credits were used, we reverse those credits. Your balance may become negative, and you won't be able to send paid faxes until it is back to zero or above. Repeated cases may lead to account review under section 7.

9. Failed faxes and refunds

If a fax fails, we return the credit automatically or, on a subscription, don't count it toward your limit. A failed free first fax doesn't use up your free fax. A fax where only some pages were delivered is treated as failed and refunded in full. Refunds of money are handled by Apple or Google. Details are in our Refund Policy, which is part of these Terms.

10. Your content

You keep all rights to the documents you send (and, once available, receive). You give us a limited permission to store, process, convert, add the required header and any cover page to, and transmit your documents, only as needed to provide the Service. You are responsible for your content and for having the right to send it. Documents are deleted automatically as described in our Privacy Policy; keep your own copies of anything you need.

11. Health information

GoFax does not currently claim to be HIPAA compliant and does not enter into Business Associate Agreements. If you are a healthcare provider, health plan, healthcare clearinghouse, or business associate, you agree not to use GoFax to transmit protected health information on behalf of your organization.

12. Disclaimers

Except as stated in these Terms and to the extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted or error-free, or that a fax will be legible on the recipient's equipment. Some jurisdictions don't allow these exclusions, so some may not apply to you.

13. Limitation of liability

To the extent the law allows, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or missed deadlines, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US $100. Nothing in these Terms limits liability that can't be limited by law.

14. Indemnification

You agree to defend, indemnify, and hold harmless WIDE WORLD LLC and its officers, employees, and providers from claims, fines, penalties, and costs (including reasonable attorneys' fees) arising from faxes you send, your content, or your violation of these Terms or the law, including laws on unsolicited advertising and telemarketing faxes and on sender identification.

15. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law rules, except where the law of your place of residence requires otherwise. Any dispute arising out of or relating to these Terms or the Service will first be addressed through good-faith negotiation. If it cannot be resolved, it will be brought exclusively in the state or federal courts located in Wyoming, and you and we consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking injunctive relief for misuse of the Service.

16. App Store and Google Play

If you downloaded GoFax from the Apple App Store: these Terms are between you and us, not Apple. Apple is not responsible for the app, its content, maintenance, support, or any claims relating to it (including product liability, legal compliance, or intellectual property claims). If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if any); Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not located in a country subject to a US government embargo and are not on any US government list of prohibited or restricted parties.

If you downloaded GoFax from Google Play, your use of Google Play is also subject to Google's terms.

17. Changes to these terms

We may update these Terms. If a change is material, we will notify you in the app or by email before it takes effect. Continuing to use the Service after the effective date means you accept the updated Terms.
